CALIFORNIA ALIGNS WAITING PERIODS WITH FEDERAL LAW

California Governor Jerry Brown has signed into law legislation to align the state’s health coverage waiting period requirements with federal law.  Earlier legislation, effective January 1, 2014, limited waiting periods to 60 days.

Senate Bill (SB) 1034 conforms California law to provisions of the Affordable Care Act (ACA).  While the ACA had established a maximum 90-day waiting period that applies broadly to employers, California had established a maximum 60-day waiting period.

SB 1034 is effective January 1, 2015 and will presumably apply to policies issued, amended or renewed on or after that date.
