NEW CALIFORNIA WORKERS’ COMPENSATION LAWS

California Governor Arnold Schwarzenegger has signed a few new laws affecting workers’ compensation.

  • AB 361 provides that, regardless of whether an employer has a medical provider network, an employer that authorizes medical treatment shall not rescind or modify the authorization for medical treatment that has already been provided. 
  • SB 186 repeals the December 31, 2009 sunset date for provisions pertaining to an employee’s predesignation of a personal physician.
  • AB 1093 prohibits denial of a workers’ compensation claim solely because the employee was attacked because of race, religious creed, color, national origin, age, gender, disability, sex or sexual orientation.
  • AB 483 requires the California Workers’ Compensation Rating Bureau to establish and maintain a web site that identifies whether an employer is insured for workers’ compensation.
  • AB 1227 makes certain changes regarding public employees on leaves of absence for injury or illness arising out of their employment.
